What is the difference between a business name and a trademark?

1- What is a business name? A Business Name is used to identify your business. However, it does not give you rights to use the name exclusively.

2- When do you need to register a business name? Only when you are trading under a name that is not your own.

3- Where does it cover? An ABN, once registered, is registered across Australia.

Quick facts about Trademarks:

1- What is a trademark? Once registered, it protects the name, logo or brand against other people using it. You need to select the industry segments you seek protection for the trademark- these are known as trademark classes.

2- Where does it cover? It grants the trademark owner exclusive use of the trademark, Australia wide for a period of 10 years.
